Holikadahan

Narsinghavapurbhimam stambhasambhavamadbhutam!
Bhaktatranaya bibhranam Vasudevamupasmahe!!

Falguna Shukla 15 (Purnima). This day, every year, Holikadahan is celebrated.

Hiranyakashipu was king of Daityas (Demons). He had developed ill feelings for God Vishnu. He thought himself more powerful than Lord Vishnu and wished that everyone should worship him instead of any God including the most powerful Shri Hari Vishnu. He started giving pains to those who believed in God Vishnu and worshipped Him.

Hiranyakashipu had four sons. The youngest one was Prahlad. Prahlad was devotee of God Vishnu since his childhood. Hiranyakashipu tried to make him understand that he, his father, was most powerful in the universe, so, he (Prahlad) should worship him (Hiranyakashipu). Prahlad had his faith in Shri Hari Vishnu and he knew that He was the Almighty God. Bhakta Prahlad was unshaken. He did not give-up worshipping Vishnu.

Hiranyakashipu got angry over it and decided to kill Prahlad. He adopted several means to kill Prahlad, but, every time Prahlad was saved by Lord Vishnu. In his last but one effort, Hiranyakashipu utilized his sister, Holika, to kill Prahlad. Holika was blessed with a shawl which when she wore, the fire would not touch her and she would not be burnt in fire.

Hiranyakashipu convinced Holika to cover herself with the shawl and sit on bonfire with Prahlad in her lap. Hiranyakashipu thought that Prahlad would be burnt and killed by the fire and Holika will come out unhurt due to her shawl. But, the result was different. Bhakta Prahlad came out of the fire unhurt with shawl on his body due to blessings of Lord Vishnu. Holika was burnt to death in the fire.

The Good won over evil.

To commemorate this victory of the GOOD over evil, HOLIKADAHAN is celebrated.

People accumulate old house-hold wooden materials, farm-wastes, tree-branches and leaves etc. at a particular place in the mohalla / village; perform puja by midnight and light the fire in the accumulated lot. They also offer the special dishes (pakora, gujiya etc.) prepared this evening in their homes in the bonfire. People sing and dance around the bonfire.

The entire celebration is called HOLIKADAHAN and symbolizes the victory of Truth (God) over falsehood (everything else).

May God Vishnu remove all evils from your life!

Memorandum submitted to ED(MKTG) on Perquisites tax

Re : Taxation of perquisites in the hands of the employees for the year 2009-2010 INCOME-TAX (THIRTEENTH AMENDMENT ) RULES,200910 SUBSTITUTION OF RULE 3 AND INSERTION OF RULE 40F
Notification No. 94/2009/F.No.142/25/2009-S O (TPL),dated 18-12-2009

Dear Sir, 
 
As you are aware, our All India delegation has already discussed the above issue on 18th February 2010 with you in person. We again place our views on record.
Kindly refer your letter Ref: EDA/ZDB/930 dated 13-02-2010 issued in the above context wherein the Corporation has issued instructions to all offices to deduct Perquisite tax from all Marketing officials. In this connection we would like to submit as follows:- 

1) The car which is given to the Marketing Official is solely in the name of Corporation and is exclusively used by the officer for official purpose.

2) Corporation has allowed the officer to use the car for personal use up to the extent of 100 kms.

3) If at all the officer uses the office car for personal purpose he/she mentions it in his/her monthly mileage statement for which all the cost is borne by him/her.

4) The notification issued by the CBDT states that where the motor car is owned or hired by the employer and is used partly in the performance of duties and partly for private or official purposes of his own or any member of his household and the expenses on maintenance and running are met or reimbursed by the employer then, Rs. 1800 per month is added to the income (where engine c.c. does not exceed 1.6 litres) and Rs. 2400 per month is added to income (where engine c.c. exceeds 1.6 litres) and income tax is deducted at the appropriate rate which ranges from 10% to 30%. Most of our cars are with engine cc of 1.6 or less. The maximum income tax that would be deducted per month would be Rs. 540/- per month (30% of Rs. 1800). In the notification what is stated is maintenance (which would include reimbursement towards cleaning, reimbursement towards replacement of tyres and batteries, repairs to vehicles etc.) and running expenses up to certain limit, and not running expenses alone. Further, the reimbursement of running expenses for marketing officials up to SDM is 3000 kms every quarter (1000 per month) and for others it is 2000 kms every quarter (667 per month), which means that if the mileage of a vehicle is 12 kms. per litre than the marketing official gets reimbursement towards running expenses and other expenses of Rs. 4000/- p.m. (except for cleaning other expenses such as repairs, replacement of tyres, batteries etc are not regular expenses). Now as per above circular Rs. 1800/- and Rs. 2400/- for below 1.6 litres cubic capacity vehicle and above 1.6 litres cubic capacity vehicle respectively has to be taken as perquisites and accordingly Tax is to be deducted, which means out of Rs. 4000/- reimbursement given by corporation Rs. 1800/- or Rs. 2400/- as the case may be is used by the officer for personal purpose which is not true.

Further we would like to state that the perquisite circular is not applicable to Central Government employees. Since LIC is established under the Act of Parliament and is directly under the Central Government i.e. terms and conditions are all decided by the Government, the LIC employees should be also exempted from this perquisite circular, for that matter you can take the opinion from our legal department and decide.
 
In light of the above points we demand:-
A plea to CBDT should be made in light of these points to reconsider their decision.
OR seek legal remedy.
OR the Corporation should bear this perquisite tax. RBI is bearing perquisite tax of its employees. The Corporation is bearing the service tax on commission of agents and on premium of around 26 crores policies. Thus the marketing officials who are already in a financial crisis could get relief.


Another long lasting demand of the Marketing officials is increasing the reimbursement amount towards cleaning, servicing and repairs expenses. We, therefore, demand that the re-imbursement of cleaning expenses should be increased to Rs. 500/-p.m. The present limit of re-imbursement of servicing & repairs expenses should be doubled.
 
We are sure that you will consider our demands at the earliest.

MEETING WITH MANAGING DIRECTOR SHRI A K DASGUPTA

You may recall that a NOINO delegation had met ED(P), ED(CRM), ED(Mktg) & ZM, WZ on Thursday, 18th February 2010. Continuing our talks on issues concerning Class I Officers, we further met Managing Director Shri A K Dasgupta on Saturday, 20th February, 2010. The following issues were again raised & the response of the MD was almost identical to the position taken by ED(P)/ED(MKTG):-
1. Delay in Housing loan instructions:- He said that the Corporation wanted the employees to get a Housing loan at lower rate of interest & the management was striving towards it. He said that the circular was expected to be issued shortly.
2. Perquisite tax on staff quarters/newspaper/loan on car under scheme VI(revised) :- He said that the staff quarters matter was sub-judice. He said that a way out could be thought on the loan on car. We reiterated our demand that the Corporation should bear the tax as is done in RBI.
3. Charter :- He repeated the management position that as of now, the government was not in a positive frame of mind & that they were constantly in touch with the finance ministry officials.
4. Implementation of E-FEAP :- We reiterated the demand of stopping the further implementation of E-FEAP till the experiment was successful in the first three branches of Mumbai DO-3 where the work has virtually come to a stand-still as a result of the failure of the programs. He assured to look into the matter immediately. However, at the time of issuing the circular, the management has went ahead & started the implementation in 8 more branches, ignoring all the protests of the employees, agents, development officers & policyholders who are the ultimate sufferers. We protest the highly callous approach of the management which would be wholly responsible for the situation arising in these 11 branches. We had also submitted a memorandum to ZM, WZ Shri S Roychoudhury on Saturday. The memorandum has been attached herewith. NOINO/NOIW delegation in Mumbai DO 3 had also met the SRDM of Mumbai DO 3 Shri Padmapati Dwivedi on Friday, 19th february 2010 & submitted a memorandum to him. A copy of that memorandum has also been attached.

NOINO will continue its efforts to bring relief to Class I Officers.

STOP FURTHER IMPLEMENTATION OF E-FEAP IMMEDIATELY

You are aware of the grave situation of the above subject. You may recall that we had a discussion on this subject on 18.2.2010. We have again taken first-hand information from the branches in Mumbai DO 3 where the situation has not changed. At the cost of repetition, we would like give you the following feedbacks in one of the branch:-

NB Module----A. Out of 512 records only 314 records are extracted. Unable to trace the missing records. B. ECS registration & numbering cannot be done. C. ULIP & Wealth Plus plan numbering is not possible. D. Alternate channel options not possible.
Sales Module---Commission cannot be released.
Accounts Module----Trial Balance of December 2009 is being extracted currently.
OS Module not working.

Very few problems have been quoted above. Our union representatives have met the SRDM of Mumbai DO 3 & submitted him a memorandum yesterday. We have attached a copy of the same with this letter.
Today, we have also met Managing Director, Shri A K Dasgupta in the morning & reiterated our demand of stopping further implementation of E-FEAP until the first three branches are stabilized & that too only after year-ending closing. He assured us to look into the matter immediately. There is no point in further putting the agents, development officers, employees & most importantly the policyholders at peril.
We, therefore, once again demand that your good self should intervene immediately & stop the further implementation due on Monday, the 22nd of February 2010.

Re : Implementation of E-Feap in Mumbai D.O.-III

The E-Feap is been implemented in our Branch 9051 since 25th January, 2010 and there after in Branch 893 and in Branch 886 from 15th February, 2010. It’s a matter of pride that Mumbai D.O.-III has been pioneer of the E-Feap, the new I.T. initiative our organization has taken.

However the same is not been of success and in all these 3 branches except Cash & NB modules (not working properly), no other module is working & the branches have virtually come to a standstill. Even in Cash and NB modules there are lot of problems faced like accepting single cheque multiple policies, ULIP collections, 15-20 minutes taken for registration of proposal, problems with registration of DMR, ZMR cases, duplicate policy numbers are getting allotted and so on. The implementation of E-FEAP has run into serious trouble. The staffs, agents, Development Officers and the policy holders of these offices are facing lot of problems.

We have information that in spite of the failure to implement it in these branches the management has decided to go ahead & implement in 8 more branches, of which 3 branches are again of Mumbai D.O.-III viz Branch 89A, Branch 89H and Branch 887.

We demand that further implementation should be stopped forthwith & undertaken only after the year-ending closing that too after the successful implementation in the above-mentioned three branches.

DISCUSSIONS WITH EXECUTIVE DIRECTOR (PERSONNEL)

A delegation of NOINO met the Executive Director (Personnel) Smt. D. Vijayalakshmi on 18th February 2010 in Mumbai. The delegation consisted of Shri Ganesh Kamath, GS; Shri Sudhakar Ingole, WP; Shri C T Joshi, VP ; Shri S K Saini, President, NOINO, NZ; Shri Pulak Dey, Secretary, NOINO, EZ; Shri Anand Jharia, Secretary, NOINO, CZ & Shri Vishwas Shastri, Secretary, WZ. The following issues were discussed:-

Charter: - We enquired about the position of the charter. We demanded that the charter should be settled without any delay. We said that we had already rejected the 17.5% offer & reiterated our demand of a wage hike based on LIC’s performance instead of comparing with the banking industry. The ED (P) replied that the management was continuously in contact with the finance ministry officials & there were efforts on the part of the management to drive home the point that the LIC employees should be paid on the strength of their performance. However, till now, the government has not showed any positive indication on this matter. The management has also conveyed the sentiments of the employees on this issue to the government & was pursuing the matter.
Transfers: - a. We demanded that request transfers should be considered before three years. We further demanded that the request transfers should be considered on next promotion round or even earlier. The ED (P) replied that presently the practice was to consider cases on health grounds & the merits of the individual cases. However, we insisted that the management come out with a uniform, transparent & codified transfer & posting policy. b. We said that there was an urgent need for defining hard stations or hard postings. E.g. complete change of language, departments like Audit, Inspection & places where basic amenities were not available. We also pointed out the problems in relieving the officer who has been posted on promotion to a place where many employees are not willing to go. In such places, till such time a substitute is available, the officer is not relieved though his transfer order has been issued. Even where a substitute has joined, the concerned officer is not relieved till he trains the substitute. The ED (P) promised to look into the matter. c. We also pointed out that the same set of guidelines applied to all. E.g. it is unfair to apply the same criteria for transfer of a person 100 kms away from his home as well as a person 1000 kms(or more) away from his home. d. We pointed out that transfers should also be considered during operation of contingency as well as considering the representation cases (supplementary list). The ED (P) replied that this depended on the policy of the respective Zones & the CO was not very keen to interfere in the same. e. We pointed out that there were problems particularly in the EZ due to the bifurcation of EZ into EZ & ECZ. The marketing officials, who originally belonged to Orissa or Bihar, were not getting transfers even after completion of 3 years or more. The ED (P) replied that she was aware of the problem & would discuss the matter with the respective ZM’s to find out a solution.
Delay in issuing Housing loan instructions: - We strongly protested the inordinate delay in issue of the instructions after the clearance of the Board on 17th November & demanded that the circular of instructions should be issued immediately. We had also submitted a comprehensive letter on the suggestions on modifications The divisions have stopped granting loans & the employees are in the dark about several aspects as to what would be the date of effect, whether a loan from outside institution would be transferred or not etc. The ED (P) informed that the matter was almost finalized & it was now with the LHPF dept & the management was trying for a better deal for the employees from LICHFL. She hoped that the matter would be resolved shortly.
Perquisites tax in respect of staff quarters, newspapers, car under scheme VI (revised):- We insisted that the matter of perquisite tax for newspapers, & car should be taken up with the CBDT; failing which we should seek legal remedy. As the matter of perquisite tax on staff quarters was subjudice, we insisted that in case in all the three matters all options were exercised & result was not in our favour, the Corporation should bear the perquisites tax. We also raised this matter with the ED (Mktg), Shri T. Chattopadhyay who assured us to find a way out in the matter of perquisite tax on car under scheme VI (revised).
Cashless mediclaim :- We enquired about the position on this issue. The ED (P) replied that the situation has changed considerably in recent times with many hospitals refusing to entertain cashless claims through TPA. Moreover, the experience of TPA till now was not good. Hence, there was a need to review the matter. She said that a decision would be taken soon in this matter.
Implementation of E-FEAP: - We pointed out that the implementation of E-FEAP had run into serious trouble. We had information that in spite of the failure to implement it in one branch of Mumbai DO-3, the management went ahead & implemented it in two more branches of Mumbai DO-3. The experiment failed there too. The serious consequences of these failures is that except Cash & NB modules (not working properly), no other module is working & the branches have virtually come to a standstill. The employees are working till midnight but no solution is forthcoming. The policy holders have been put to a lot of distress. To top it all, the management has decided to go ahead & implement in 8 more branches, turning a deaf ear to all protests of the employees. We demanded that further implementation should be stopped forthwith & undertaken only after the year-ending closing that too after the successful implementation in the above-mentioned three branches. Whatever may be the compulsion, it should not be at the cost of the policyholders & the employees. The ED (P) promised to look into the matter. We followed up this matter with ED (CRM) Shri D. Tarafdar & ED (Mktg) Shri T Chattopadhyay. Both of them assured to look into the matter after hearing us patiently. We will also follow-up this matter with the ED (IT) who was not available at that juncture.

Joint-front decisions on 15th February 2010

Dear Friends,

A joint meeting of unions and associations in LIC was held today at Mumbai.

The meeting congratulated all the employees and officers who made the ONE DAY STRIKE on 21st January 2010 a tremendous success. The unprecedented success of One Day Strike sent a clear signal to the LIC Management that the employees and officers are prepared for a sustained programme of action to achieve a satisfactory wage settlement.

But the management of LIC seems to miss the signals of the employees’ unrest and is mistaking the patience for granted. The employees and officers are not in a mood to accept this insensitive attitude. They want to make it clear that the unified voice and demand for improvements over the offer of 17.5% brooks no more delay.

The government decided that the public sector undertakings which can decide on wage revision on their own without seeking any support from the government can do so. But in respect of LIC such a clearance is not forthcoming from the Finance Ministry Officials. It is for the LIC Management to assert their right to settle a wage revision on the basis of the performance of LIC.

The meeting of the unions held today decided to call upon the officers and employees to implement the following programme of actions to press forward our demand for an early and good wage revision.

 Dharna before Divisional Office on 6th March 2010 (Central Dharna at Jeevan Bharti Bldg., Parliament Street, New Delhi).
 Signature Campaign programme from 8th to 12th March 2010. Signature Memorandum to be submitted to the Office In-Charge on 12th March 2010.
 Joint Front to meet again on 13th March 2010.
 Withdrawal of Extra Co-operation from 15th March 2010 till the Current Year Financial Closing of LIC. (Close of Cash Hours as per Office Timings. No late sitting. No work on Sundays and Holidays).
 One Day Strike on 31st March 2010.

NOINO NOT TO PARTICIPATE IN THE STRIKE CALL GIVEN BY CLASS I FEDERATION

Dear Friends,

Our attention has been drawn to the strike call given by the Class I federation supposedly to protest the arrest of their President(released after some time). NOINO wishes to clarify that it is not a party to the strike & will not participate in the said strike. The reasons are as follows:-

1. NOINO is the part of the joint front which has been following a course of agitation. We have met in Mumbai on 15th & decided on the course of the programme. NOINO will go ahead with that programme.
2. The strike call is an individual call given by an individual union for the situation arising of their individual agitation programme. We believe that every association or union draws upon their own strategy before embarking upon their agitation & hence this strike is a part of that strategy. We do not want to comment on the merits or demerits of this agitation & reserve our comments for a later date that too, if necessary. The Class I federation did not consult anybody including NOINO before embarking upon their individual agitation & hence logically there is no need to join it now.
3. NOINO & the joint front has time & again appealed to the Class I Federation to join the joint front instead of going alone(it is another matter that it has been wrongly accusing NOINO & joint front of not accomodating it into the joint front). But it has consistently stuck to the stand of "NOT BEING A PART OF ANY JOINT FRONT OF WHICH NOINO IS A PART". We feel even now it is not late. Going alone will not help the cause of achieving our goal of a handsome charter. We appeal to the Class I federation to give up their stand & join the joint front programme.

REPORTING OF EC MEETING OF NOINO AT KOLHAPUR ON 24TH & 25TH JANUARY 2010

The Extended EC meeting of NOINO was held at Kolhapur on 24th & 25th of January 2010. Around 70 delegates (including 8 lady representatives) representing 37 divisions attended the meeting.
Our dynamic President Shri Prakash Javadekar, MP, Rajyasabha presided over the meeting. Another notable guest for the inauguration ceremony was the local graduates’ constituency MLA Shri Chandrakantdada Patil. The meeting was formally inaugurated by Shri Javadekar. In his inaugural address, Shri Javadekar lauded the progress of NOINO in a short period & reiterated our commitment of attaining majority at the end of year 2011. Shri Chandrakantdada Patil extolled the virtues of BMS associated unions & promised support & help to the cause of NOINO.
After the inaugural ceremony, the first session of began. In this, various representatives came forward & narrated the feedback about the grievances of the Class I officers. They also had some very useful suggestions about resolving the same. They also reported that the expectations from NOINO were very high due to the disillusionment with the so-called majority organization on one hand & the remarkable initiatives taken by NOINO to resolve the problems of Class I Officers on the other hand.
The second session of stock-taking was entirely conducted by our charismatic President Shri Javadekar. He asked the delegates various questions regarding the organizational work done by them & the state of affairs in LIC.
The session ended with a riveting speech by Shri Javadekarji. He enthralled the audience by his clear thoughts & logical analysis. He expressed his anguish over the inordinate delay in the settlement of the charter. He said that he, as a President of NOINO rejected the designs of the Government-management combine of bracketing LIC with banking industry & said that he would do everything to break this unnatural comparison. He said that he would raise the matter of conferring of ‘Navratna’ status on LIC in the ensuing session of Parliament. The delegates were charged up after the speech.
After lunch, the third session began. This session was devoted to organizational matters. Almost all the representatives reported on the tours they had undertaken in the last six months, the effect of the 1 day strike in their divisions, & their future plans to expand the organization. The representatives also expressed their satisfaction on the efficient & timely communication by the leadership. The subject of Fund-raising was also discussed in this session.
The session ended with the speech of the All India General Secretary, Shri Ganesh Kamath on ‘Organization’. In a speech lasting for 45 minutes, he warned the delegates against being complacent due to the achievements & the fast growth of NOINO. He said that loyalty & adherence to principles should also be coupled with actual & practical field work by the activists. He exhorted the delegates to canvass about the achievements & the efforts of NOINO among all the Class I Officers & strengthen NOINO.
The last session of the meeting was attended by the All India Office-bearers. In this reporting was done about the working of various units in the respective Zones by the Zonal Secretaries. The meeting noted with satisfaction that NOINO was going from strength to strength & there was a great possibility of opening of new units of NOINO in several parts of the country. It was also resolved that further efforts would be made to bring pressure on the management & the Government both on the organizational level as well as the JOIINT FRONT for an handsome charter without any further delay. Tour programmes of the General Secretary & the Working President in the next three months were also decided.
On the next day, i.e. 25th January 2010, the opening session started with a thorough discussion on some of the important issues concerning the Class I Officers like the further action on the Charter front & the modifications required in the promotion policy from Class III to Class I. It was interesting to note that several delegates came forward & made valuable suggestions. These suggestions have been noted & action would be taken on the same by the organization.
The next session was the key-note address by the Working President, Shri Sudhakar Ingole. In his usual lucid style, he motivated the delegates to work for the organization. He lauded the NOINO activists for working against all odds & asked them to keep up the good work. He also said that in BMS we believed that working for the organization is a divine work & we should continue to think & act selflessly. He expressed his confidence that very soon a time would come when NOINO would be the deciding factor. The audience was inspired by his captivating speech.
The meeting concluded with a well attended gate meeting at the Kolhapur divisional office. The main speakers in this meeting were Shri Ganesh Kamath, GS, NOINO & Shri Sudhakar Ingole, Working President, NOINO. In their hard-hitting speeches, both the speakers came down heavily on the Class I Federation for their quixotic stand of “not being a part of the joint front of which NOINO is a part of” thereby hurting the interests of the Class I Officers when the need of the hour was to join hands forgetting all our differences. They reminded all concerned that NOINO had made an attempt to have an all-inclusive joint front by appealing to all unions (including the Class I Federation) when it had taken initiative & written to all unions for a joint front on 28.5.2008. It had also publicly welcomed the move of the President of Class I Federation when he addressed a mammoth rally of the joint front at Yogakshem on 16th December 2009. In spite of this, the Federation continues to play truant thereby harming the interests of Class I Officers. The speakers further expressed their resolve to abide by the programmes of the Joint front till a logical solution was reached.
All in all, the EC meeting was hugely successful. No praise would be too high for the NOINO activists of Kolhapur such as Sanjay Patil, Sanjay Baraskar, Shrinivas Danke, Sameer Parulekar, not to forget our veterans like Shri Terwadkar, Shri Jaysing Koli & Shri Sonavane who did an excellent job of organizing. We are also grateful to the local NOIW activists for rendering support & help.
NOINO will continue its efforts to bring relief to the Class I Officers in LIC.
